A man who started a beer garden punch-up at a Yeppoon hotel later unleashed ‘appalling’ conduct on hospital staff.

A man who threw the first blow in a beer garden punch-up at a Yeppoon hotel has copped a year-long banning order from the popular pub.

Angus Ramsay Boyd was also later refused admission to hospital because of his “appalling” behaviour.

The 40 year old pleaded guilty in Yeppoon Magistrates Court on March 16 to public nuisance in the vicinity of a licensed premises and creating a disturbance on health services land.

Police prosecutor Brandon Selic said about 11.20pm on February 24, Boyd was involved in a verbal altercation with other patrons in the beer garden of The Strand Hotel.

Mr Selic said a physical fight then happened in the “crowded” beer garden and Boyd struck another patron in the head.

The prosecutor said when police arrived at the venue, Boyd was outside “shirtless and bleeding from the mouth.”

Mr Selic said security at the hotel told police Boyd had thrown the first punch.

Mr Selic said Boyd was intoxicated and he was arrested and taken to the police station where paramedics treated him.

The court heard Boyd had to be taken to Yeppoon Hospital and it was there he yelled and swore at hospital staff.

Boyd was warned about his behaviour but he continued yelling and swearing at staff, Mr Selic said.

Boyd was refused admission to the hospital, the court heard.

The court was told Boyd had no criminal history and the prosecution submitted for a banning order.

A self-represented Boyd told Magistrate Cameron Press he “obviously drank too much” on the night of the incident and as well as being intoxicated, he was also concussed.

Mr Press said Boyd’s behaviour at The Strand was unacceptable and his conduct at the hospital was appalling, before fining him $1500.

Mr Press imposed a 12-month banning order at The Strand Hotel for Boyd.

Convictions were not recorded.
