Schuyler Batty sentenced for Andergrove Tavern assault in Mackay Court

A magistrate has slammed a Qld pub goer for his ‘total loss of control’ after he lashed out, attacking a fellow punter at a popular venue.

A Mackay man learned his fate after viciously assaulting another punter at a popular Mackay pub.

Schuyler Batty was at the Andergrove Tavern on July 11, 2024 when he attacked another man, repeatedly punching him and causing multiple facial injuries including cuts and a fractured nose.

Mackay Magistrates Court heard the victim had told Batty to “man up” which led to Batty punching him “at least 10 times”.

Defence solicitor Steven Hayles said “it’s an unfortunate incident that happened” and his client accepted his behaviour was “completely over the top”.

The court heard Batty had no criminal history and a number of character references were submitted on his behalf.

“This seems to be somewhat of an aberration according to the character references and the history,” Mr Hayles said.

Mr Hayles said Batty could pay $2000 compensation to his victim, and he also offered a letter of apology to the man.

Police prosecutor Matt Saunders said the “challenge” from the victim to Batty did not constitute provocation and ultimately advocated for three to six months jail.

Acting magistrate Michael Bice said Batty should have been “strong enough” to walk away from the victim or go to security and “say this person was annoying us can you have him removed”.

Batty was given a three month sentence of imprisonment, suspended for 18 months and order to pay $2000 to the victim.

“There was a discussion about you manning up and that obviously provoked you to take action but in my view does not amount to provocation,” Mr Bice said.

“You showed a total loss of control and you viscously, viciously attacked this person, this victim.”

Batty was handed a wholly suspended three-month jail term that will hang over his head for the next 18 months.

He was also ordered to pay $2000 in compensation and convictions were recorded.

“I hope going forward you’ve learned from this,” Mr Bice said.

Batty said “I have, your honour”.
