A young man was caught illegally riding an e-scooter started screaming at police before he fled their custody “by unknown means”.

Tevin Howard Colman was riding with a passenger and without a helmet on Sydney St, when officers from the Mackay Police Station observed him and stopped him.

Police prosecutor Sergeant Linden Pollard said Colman told officers “no” when he was asked to come to the station and began showing abuse.

“Defendant replied ‘You c**ts are f**king pathetic, you’re f**king pathetic” while members of public were in vicinity,” Sgt Pollard said.

“He acknowledged he understood the direction ... then replied stating ‘This is f**king b*llsh*t’.

“He has attended the counter of the police station (but) decamped by unknown means.”

The court heard he then did not appear when ordered to court and, when found and arrested at a home searched for another matter, said he had no idea he had been summoned.

“He said he couldn’t care less because the matters were trivial and he didn’t like the magistrate,” Sgt Pollard added.

Once in custody, the court heard Colman then used food to obstruct a surveillance camera in his cell which was then rendered inoperable.

Colman pleaded guilty to carrying people on device, contravening a police direction, failure to appear, and wilful damage of police property.

ATSILS lawyer Daniel Lane said his 30-year-old client had two children and was a roofer by trade, describing the offences as “silly behaviour” he had shown remorse for.

“(It’s) mindless anti-social offending exacerbated by, potentially, the officer’s prickly demeanour and my client’s distaste for authority,” Mr Lane suggested.

“Is that your submission?” Magistrate Stephen Byrne asked.

“Yes, your Honour, I can’t take it any further than that.”

Mr Byrne sentenced Colman to a $161 fine for the e-scooter offence, $300 for contravening police directions, $250 for failing to appear, and $300 for wilful damage.

Convictions were recorded and a total of $1011 in fines were referred to SPER.
