Mackay teen arrested for his role in violent home invasion and running naked down Sydney Street in Mackay

At age 16 he held a door closed during a violent home invasion. Five months later he ran naked in the city centre in a drug-fuelled frenzy.

A teen who held a door closed during a violent home invasion also ran naked down a Mackay CBD street in a drug-fuelled frenzy and had to be tasered.

Mackay Childrens Court heard the boy was 16 years old when he and Shane Edwin Aughey gained entry to the Victoria Plains Home on June 30, 2020 with their faces covered.

Aughey repeatedly bashed 53-year-old James Langley in his bed while the teen, who cannot be named as he was a juvenile, held the bedroom door closed preventing the victim’s partner and son from aiding the screaming man.

Aughey and Mr Langley were formerly friends before the shocking assault for which he was jailed for 2.5 years with immediate parole.

The court heard Mr Langley received a minor broken nose.

Crown prosecutor Samantha O’Rourke said the teen initially denied any involvement.

He pleaded guilty to burglary with violence and obstructing police on November 28, 2020.

The court heard police were called to Sydney Street where he was “running naked down the street”.

Ms O’Rourke said an officer tried to engage with the then-17 year old but he became aggressive, turned on him and kept moving forward.

“A taser was deployed to restrain him,” Ms O’Rourke said, adding he had appeared affected and refused to give his personal details to police.

Judge Julie Dick highlighted two main factors in the teen’s favour – he was being sentenced as being “a party” to the home invasion as opposed to the main offender and he was being dealt with under the Youth Justice Act.

Defence barrister Matt Heelan said his client had been on a conditional bail program for the past eight months “and he’s thrived under that”.

The teen was working full time, his employer knew about the charges and still wanted to support him.

Mr Heelan pushed for a good behaviour bond, arguing “it recognises that he was led astray by a hardened criminal” in Aughey.

Judge Dick told the teen home invasions were considered very serious, even more so when it involved violence and more than one person.

“It’s had a huge effect on them (the victims) and I take that into account,” Judge Dick said, adding the obstruction five months later was “clearly a drug-driven offence”.

“Why you’d think no one would interfere with you running naked down a main street I really don’t know, but anyway someone did and it was a police officer.”

Because of his work situation, Judge Dick determined the best penalty would be a 12-month good behaviour bond. Convictions were not recorded.
