Mackay man pleads guilty to rape, sentenced to three years

A Mackay man has been sentenced to three years in jail for violent rape that left his partner in a “great deal of pain”.

The 50-year-old man’s partner had returned home from work drinks on October 30, 2021 and gone to bed when the man performed an extreme sex act.

He pleaded guilty in Mackay District Court on Wednesday to one count of rape for his actions that night.

The court heard the man got into the bed and made sexual advances towards his partner who asked him to stop, even punching him to try and persuade him to stop.

Crown Prosecutor Elizabeth Kelso said the woman felt a “burning” sensation which could have also been caused by the man using chilli in his dinner early on and not washing his hands.

She said the fist rape continued for more than a minute.

Ms Kelso said the woman’s daughter notified the police of the rape and the woman was taken to hospital, where a doctor examined her and noted a tear.

The man told the police he had stopped when asked but he was charged and has remained in custody since October 31.

The prosecution asked Judge Ken Barlow to sentence the man to three years in jail.

Defence Barrister George Kalimnios argued for a head sentence in the range two years to two-and-a-half years with three more months in jail before suspending the balance of the sentence.

Judge Barlow said the statement of facts showed the man did not stop when his partner asked him to.

“You put your entire fist in her vagina … causing her a great deal of pain,” he said.

“She says that that evening has destroyed her life and she constantly thinks of it and is in constant fear of you or someone on your behalf contacting her or watching her and she is also scared of men generally.”

The court also heard the man had been convicted for previous domestic violence offences.

“It seems to me that despite the fact that you were convicted and sentenced by courts on two occasions on three separate offences, you have no insight into your behaviour,” Judge Barlow said.

“You are a mature man who should have realised that this behaviour was unacceptable.”

The man was convicted and sentenced to jail for three years.

He is eligible for parole on November 30, 2022 after he has served about 13 months.
