A repeat sex pest has offered $500 as a sorry to the “vulnerable” woman he left upset and distressed after texting her a penis photo and explicit message months after booking her services as a massage therapist.

When Whitsunday man Justin Luke Chivers arrived for the appointment he stripped naked despite being told to leave his underwear on, Mackay Magistrates Court heard.

The encounter made the Whitsunday woman, who was legally blind, uncomfortable, but the pair had no further contact until August 23, 2023 when he sent her a text message “which contained a depiction of male genitalia and a comment”.

The court heard the incident distressed the victim so much stopped working as a massage therapist and changed her career path as a result.

Chivers, 46, was found guilty after a contested hearing in Proserpine Magistrates Court in May to using a carriage service to menace, harass, or cause offence.

This is not the first time he had fronted court for this time of offending.

The court heard in 2011 he pleaded guilty to sending a married woman obscene and sexual messages including dozens of images of himself in sexual nude poses.

It was unknown how he obtained her phone number.

Self represented on Thursday, Chivers said he was prepared to offer his latest victim $500 in compensation “for the stress and anxiety caused to her”.

When Magistrate Michelle Howard asked if he had sought professional help to address any issues given the like offending on his criminal history, Chivers said, “I think that’s just something I’ll just deal with on my own undertaking your honour.”

The was after the court heard Chivers initially found it difficult to understand how his behaviour caused offence to his victim.

The court heard he had since “went away and tried to put myself in her shoes”, and accepted she was “vulnerable” and a female and empathised that his conduct might have caused offence.

Ms Howard said she was concerned Chivers had not spoken to a professional about this behaviour.

As a result she placed him to complete six months probation and placed him on a 12-month $1000 good behaviour bond and a conviction was recorded.

Ms Howard ordered the $500 compensation be paid to the victim.
