A Mackay mother charged with murder over her youngest daughter’s death says she is investigating why an autopsy was carried out on her child and “graphic photographs” included in the police brief of evidence.

Jessica Blinda Polsoni, who also goes by the name Hanbury, and her husband Adam Hanbury are charged with the murder of their two-year-old Diana Hanbury in 2022.

Police allege Diana, who is the youngest of six children, was already dead when Ms Polsoni took her to Mackay Base Hospital about 8pm December 29.

They further allege the young girl had been unwell in the days before she was taken to the emergency department and that Mr and Ms Polsoni neglected to get her appropriate medical attention in the lead up to her death.

Ms Polsoni is attempting to have the case against her struck out.

She appeared in Mackay Magistrates Court on Wednesday backed by her cohort of supporters with an application against the Department of Child Safety.

She told the court there was “a lot of confusion” over who actually brought the case against her.

“We have been investigating into the autopsy performed on my daughter as there has been very graphic photographs included in the brief of evidence which forensics says is very unusual that that has even turned up,” Ms Polsoni said.

“And we are questioning further through investigations why that autopsy even needed to be done considering the diagnosis.”
Ms Polsoni said they had come to the conclusion someone in the “Department of Child Safety, the Child Investigative Protective Unit” – CPIU “is actually initiating and bringing all these charges”.

Acting Magistrate Nigel Rees asked if Ms Polsoni had served her material on the other party, to which she said she did not believe anything needed to be done for the committal process.

Mr Rees highlighted Ms Polsoni already had an application before another magistrate which was listed for decision next month.

As a result, he adjourned this current application to marry up with the same date.
