A Mackay man has tried to drag his girlfriend out of a car by her hair on the side of a highway after she threw his phone out the window.

Mackay Magistrates Court heard Cody James Kulldulla was driving to Walkerston on January 29 when she noticed a text on his phone from another woman.

Police prosecutor Matt Saunders said she began to punch and hit him before throwing his mobile out the window.

The court heard the 28 year old responded by telling her words to the effect of “I’m going to kill you, I’m going to punch the shit out of you several times harder and I’m going to make sure that I set your house on fire.”

Mr Saunders said Kulldulla also punched her and pushed her head down – while still driving the vehicle – before pulling over on the Peak Downs Highway and trying to drag her out of the car while threatening to spray her with wasp spray.

Mr Saunders said she refused to get out and when they arrived at the Walkerston address, she phoned triple-0 for help and was taken to Mackay Base Hospital while police officers arrested Kulldulla and took him back to the watch-house.

There officers found he had possession of another person’s debit card which Kulldulla had found “some time ago” on the road and not bothered to report.

The court further heard that officers, just hours before the car incident, had issued Kulldulla with details of a contemporary protection order with his victim as the aggrieved.

Kulldulla, who was self-represented in court, pleaded guilty to contravening the order, driving while disqualified, and unlawful possession of a credit card.

He also pleaded guilty to failing to appear before court on February 19 as well as again contravening the protection order on March 3 and wilful damage of property.

Mr Saunders said Kulldulla had messaged the aggrieved that she was a “cheating dog” and “that she never loved him” before going to her home where he yelled, “It’s not okay for another man to be there” and also smashed garden ornaments and a pane of glass.

Speaking to Acting Magistrate Stephen Byrne via videolink from Capricornia Correctional Centre, Kulldulla said: “I apologise for my actions, the way I dealt with it was a disgrace”.

Mr Byrne said a letter from Kulldulla’s employer spoke well of him as he sentenced the South Mackay man to $1300 in fines and recorded convictions, and ordered he be released from custody after serving 74 days.
