Brett Robert Hudson faces Mackay court for wilful damage

A father of three covered his partner’s mouth to silence her screams while saying ‘I should have smashed your … head in’ before using an axe to break through a glass window.

A former mining superintendent has threatened to smash his partner’s “head in” before using an axe to break through a glass window.

Brett Robert Hudson grabbed his partner’s throat, said “I should have smashed your fu--ing head in” and then threw her on the bed and covered her mouth.

Prosecutor Leonie Taufa’ao said the partner had followed Hudson into the bathroom at their Andergrove home on October 10, after raising his cheating which she alleged was done to “purposely hurt her”.

Ms Taufa’ao said Hudson told his partner to “shut her fu--ing mouth” before she used her forehead to push him away from her, and he reacted with violence.

“The defendant felt he had been headbutted by the aggrieved but she denied (this),” Ms Taufa’ao said.

The aggrieved, who has not been charged, ended her relationship with Hudson on October 17.

About 9.15pm on October 18, Hudson arrived home from the mines earlier than expected and began “banging” on the glass door to be let inside but she told him “she did not feel safe”.

Ms Taufa’ao said Hudson then used an axe to smash through a glass window as he had gastroenteritis and had to use the toilet.

Mackay Magistrates Court said Hudson then threw his former partner’s clothes around.

Barrister Scott McLennan, instructed by McKays Solicitors, said while the house was in the aggrieved’s name, Hudson was living there having made “substantial” financial contributions.

Mr McLennan said on October 10, the aggrieved had instigated the argument with Hudson after discovering his friendship with two women at his workplace.

He said she had earlier texted the women “essentially warning them off”.

Mr McLennan said Hudson had tried to escape the argument but she followed him and headbutted his nose, causing his eyes to water – which is when he “spontaneously” grabbed her by the neck and threw her to the bed.

He said she began screaming and Hudson covered her mouth to prevent his 17 year old daughter overhearing.

Regarding the October 18 incident, Mr McLennan said Hudson had discovered his clothes “had been packed up” and so she removed his former partner’s clothes to return his to their place.

Mr McLennan asked Magistrate Stephen Byrne to consider not recording convictions as the Clermont-born father of three teenage children hoped to return to Papua New Guinea to work as a superintendent.

Mr Byrne said the “most appropriate remedy” was a fine, considering the 44 year old’s previous domestic violence offences in 2016 were dated, and convictions would prejudice employment prospects.

“I just hope your emotions don’t get the better of you moving forward,” he said.

Pleading guilty to wilful damage, Hudson was fined $1500. Convictions were not recorded.
