Case adjourned for Homebush attempted-murder accused Damon Mitchell Holmes
A 31-year-old Mackay region man accused of shooting a man in the hip will remain in custody on remand as his lawyers await evidence.
A man charged with attempted murder over a shooting incident at Homebush has had his case adjourned as his lawyer waits for evidence including the ballistics report for the firearm allegedly used.
Police allege a 40-year-old Oakenden man went to a Palm Tree Rd address where an altercation with 31-year-old Damon Mitchell Holmes occurred about 2.30pm on October 7.
During the altercation police allege Mr Holmes fired a weapon in the direction of the 40 year old.
As a result the older man suffered a gunshot wound to his hip.
He was later taken to Mackay Base Hospital in a stable condition.
Mr Holmes, a 31-year-old Alligator Creek man, was mean to appear in Mackay Magistrates Court on October 15 but his appearance was excused as he remained in custody.
His lawyer, Marcus Hahn from McKay Solicitors, sought an adjournment while police waited for a brief of evidence to return.
A disclosure of the alleged victim’s statement was also requested.
A ballistics certificate for the firearm will be used to form part of the brief of evidence, however Mr Hahn said this could take months.
The case was adjourned to December 9 for further mention.
