Ipswich jury finds Juan Rafael Diaz not guilty of teen rape

A second jury has found an Ipswich man not guilty of rape after a two-day trial.

Ipswich man Juan Rafael Diaz has walked from a courtroom a free man after a jury found him not guilty of digitally raping a child.

Mr Diaz, was charged with rape and indecent treatment of a child under the age of 16.

His name was cleared after a two-day trial at the Ipswich District Court this week after a jury was unable to confirm, beyond reasonable doubt, he had digitally raped the girl.

It was the second jury Mr Diaz faced this week after the first was dismissed over an issue with evidence.

Crown prosecutor Michelle Parfitt alleged the married man had taken advantage of the teenager.

The teen’s parents gave evidence during the trial and the court heard they reported the allegations to police days after their daughter told them of the incident.

The girl’s mother said they had decided to report the claims after advice from a lawyer and following a family meeting.
