A trial against a man accused of raping a woman with a dildo has been declared a mistrial after a jury failed to agree on a decision.
Throughout the past week, Yeronga man Eamonn Nial King has denied three counts of assault occasioning bodily harm, raping a woman with a dildo, and attempting to rape her with his penis in 2018.
The jury deliberated for three hours yesterday, and after further deliberation this morning, they indicated they were unable to reach a verdict.
They still failed to come to a decision after Judge Amanda McDonnell asked that they deliberate further.
After another three hours, the jury were still at an impasse and Judge McDonnell proposed they deliver a majority verdict.
However, the jury were unable to come to a majority decision on any of the four charges, and they were ultimately dismissed.
Mr King’s matter was listed for callover on October 25, 2022, and his bail was enlarged.
