When Shane Dallas Jackson crashed the car he was driving in the Gladstone region, a member of the public stopped to help him.
But Jackson became aggressive.
Police attended the scene and they saw the damaged Mitsubishi Lancer on the side of the road with a wheel missing.
By that stage, Jackson was sitting in the passenger seat with loud music playing.
Police asked him if he was okay and he replied: “I’ve been sitting here smoking bongs... and drinking piss, f*** off and leave me alone.”
Police continued to speak with Jackson and he removed the keys from the ignition and threw them on the side of road.
He also threw XXXX beer cans out of the car.
Jackson was “heightened” and he yelled at the officers.
At one point he opened the car door and said: “I’ll come and get you.”
Police asked what Jackson was “getting them for” and he replied: “F*** off and leave me alone.”
While still screaming at police, Jackson placed a bowl which contained cannabis on his lap and he drank a can of XXXX beer.
Police told him that he was under arrest for possessing dangerous drugs and Jackson responded by emptying the bowl of cannabis out the driver’s side window and saying: “What drugs?”
Jackson continued drinking.
Police asked him if there was “anything on him he shouldn’t have” and Jackson replied: “Come and find out, come and find the f*** out.”
A short time later, Jackson got out of the car and asked the officers if they were “coming for a walk.”
Police said: “No Shane, you’re staying here.”
Jackson then ran into long grass, saying “let’s go” but he only made it a short distance before he fell over.
He lay on his back, facing police.
Using his left leg, he struck out towards one of the police officers while saying “C’mon, c’mon, c’mon.”
Police deployed capsicum spray, told Jackson not to move and that he was under arrest for assaulting police.
They attempted to provide Jackson with “after care” for his eyes, and he refused to stand up.
Police requested help from Queensland Ambulance Service due to Jackson’s level of intoxication.
But Jackson verbally abused police, saying: “You’re a sh** c**t, you’re a sh** c**t, you blue coat f***ing sh** c**t.”
While sitting down, Jackson moved his right hand towards his face and then moved it back towards one of the officers who asked: “Are you wiping that on me?”
Jackson replied: “Yeah f***ing oathe I am, you f***ing dog.”
Jackson then turned his head and “spat forcefully” towards one of the officers - it did not make contact.
Another officer came towards Jackson and Jackson turned and wiped bodily fluid from his face onto that officer’s arm.
Jackson was pushed to the ground and he wiped his face and bodily fluid on an officer’s boot.
After being put on an ambulance stretcher, Jackson grabbed an ambulance officer’s hand and attempted to bend his fingers back.
Police had to intervene for Jackson to let go.
Jackson was taken to hospital after the incident on August 14.
Jackson, 47, accepted that version of events in Gladstone Magistrates Court where he pleaded guilty to numerous charges including two counts of seriously assaulting police, and one count each of seriously assaulting a public officer, obstructing police, consuming liquor on a road, failing to provide a specimen of breath, and public nuisance.
The court heard Jackson’s criminal and traffic histories were both two pages.
Police prosecutor Kelvin Boyd said this latest offending happened while Jackson was on a suspended sentence for serious assault of a police officer.
Solicitor Jun Pepito said Jackson, a father of three, had lost his job as a panel beater prior to this incident.
Mr Pepito said that loss of employment caused “some friction” in Jackson’s household for financial reasons and he resorted to drinking alcohol every day, buying the drinks with his savings.
The solicitor said on the day of the offending, Jackson got in the car and drove after an argument with a family member.
During sentencing, Magistrate Mary Buchanan said police did not need to be subjected to this sort of behaviour while going about their duties.
“And the fact that you were upset because of your personal circumstances of losing your job, turning to drinking too much and arguing with your father-in-law gives some context but is no excuse for this sort of behaviour,” Ms Buchanan said.
She activated the suspended sentence in full and sentenced Jackson to eight months’ jail with parole release fixed at January 13, 2025.
Ms Buchanan also ordered Jackson perform 160 hours of unpaid community service and she disqualified him from driving for seven months.
Convictions were recorded.
