A mother of two narrowly avoided prison time after a flick knife and marijuana seeds were found in her Clinton home, a court heard.

Sarah-Ann Fleming Haines, 28, pleaded guilty to four charges in Gladstone Magistrates Court on Friday including possessing dangerous drugs and utensils .

Police prosecutor Senior Sergeant Merrilyn Hoskins told the court Gladstone police executed a search warrant on Fleming Haines’ Wistari Street address in Clinton on July 2, around 2.30pm.

“Prior to the search commencing, Fleming Haines declared a metal pipe and cone piece in a draw of the coffee table,” Ms Hoskins said.

“When questioned about the item, Fleming Haines said it was hers and she used to smoke weed as recently as that morning.

“Police then located 1.8 grams of marijuana seeds inside a yoghurt container on the kitchen table and Fleming Haines said they were “weed seeds” and she had forgotten they were there.

“Finally, police located a flick knife and Fleming Haines said she had been given the item as a birthday present last year and did not know it was illegal to have.”

Fleming Haines’ lawyer Rio Ramos said her client conceded she had a problem with dangerous drug use.

“She is trying to move forward and get off the drugs,” she said.

“There have been some positive changes in Ms Fleming Haines’ life and she has addressed her drug use and also her parenting issues.”

In sentencing, Magistrate Bevan Manthey said Fleming Haines’ previous history brought her very close to serving prison time.

“You were a sparrow’s fart away from serving actual time today,” Mr Manthey said.

“I hope I don’t see you again, but at the end of the day it is your call.”

Fleming Haines’ was convicted and sentenced to nine months imprisonment with immediate parole release. The drugs and weapon were forfeited to the Crown and convictions were recorded.
