DV offender Joshua Matthew Allinson breaches suspended sentence

A 34-year-old domestic violence offender started breaching a suspended jail sentence just 20 days after it was imposed, peppering his ex with incessant messages.

As a judge dealt with a Central Queensland domestic violence offender who breached his suspended jail sentence, she told him: “quite clearly you have a problem dealing with the end of a relationship.”

Joshua Matthew Allinson, 34, faced the District Court at Gladstone for breaching a suspended sentence imposed earlier this year.

Back in February, Allinson was sentenced in the same court after pleading guilty to common assault and wilful damage (domestic violence offences).

That offending involved Allinson grabbing his partner at the time in June, 2023, throwing her onto a couch, holding her throat with one hand for about four seconds, and throwing her phone onto the road, which smashed its screen.

Judge Craig Chowdhury noted Allinson had spent 23 days in pre-sentence custody and sentenced him to three months’ jail, suspended after serving 23 days, for an operational period of three months.

In court last week when Allinson appeared for the breach, Judge Vicki Loury said: “It wasn’t a very difficult sentence to comply with - it wasn’t a very long sentence.

“All it required you to do for three months, was to not have any contact with her (victim).

“But instead, 20 days after the sentence, you started engaging in text messages with her and in that very short period of three months, you exchanged more than 2500 text messages with the complainant.”

The court heard in total Allinson sent the woman 2532 texts but none of them involved any threats.

“She (victim) did respond to the text messages herself but that frankly doesn’t make it any better,” Judge Loury said.

“There was a sentence imposed for a reason - it was meant to be punishment for you.

“I could very well send you back to jail today.

“By your conduct, you’re telling me you want to go back to jail today.

“I’m told though, that you’re still working.

“You were working at the time of your sentence and you’ve returned to your boilermaker apprenticeship.

“You instruct that you don’t have contact with the complainant anymore and you’re living in Calliope with your grandmother.

“I will give you one chance - but that’s it.

“You breach this sentence of imprisonment, you contact her again, you’ll be in jail.”

On September 12, Judge Loury was satisfied Allinson had breached his suspended sentence and she activated the whole of it, ordering his release on immediate parole.

“You will be on parole for a little over two months - take what assistance you can from the parole office, Mr Allinson, because quite clearly you have a problem dealing with the end of a relationship.”
