Cole Matthew Duggan sentenced to one month imprisonment for consistent drug offending

“He has been afforded every opportunity by the court and every sentencing option has been explored.”

That is what Magistrate Bevan Manthey told 37-year-old Cole Matthew Duggan when sentencing him in Gladstone Magistrates Court on Friday.

Duggan pleaded guilty to possessing dangerous drugs, possessing utensils or pipes that had been used, and possessing property suspected of having been used in connection with the commissioning of a drug offence.

Prosecutor Kelvin Boyd outlined Duggan’s offending, which arose from a police search warrant executed at a Shilling Street residence at Turkey Beach on July 17.

About 3.20pm, police detained Duggan and found a clip-seal bag which contained 3.5 grams of marijuana in a kitchen drawer.

Duggan told police he owned it, and police also located a small white bowl with about 0.3 grams of marijuana in it which also belonged to Duggan.

On the same table, police located an electric grinder which contained marijuana and Duggan admitted to using it to chop marijuana that day.

Beside the electric grinder was a homemade bong, made out of an ice coffee bottle and a hose piece.

All items were seized by police.

In sentencing, Magistrate Bevan Manthey told Duggan’s lawyer Jun Pepito that his client’s six-month suspended sentence would be activated.

“He’s got a long history of offending and in the past has been afforded every opportunity by the court and every sentencing option has been explored,” Mr Manthey said.

Mr Manthey sentenced Duggan to a head sentence of nine months’ imprisonment, with a parole release date of October 31.

Convictions were recorded.
