A Central Queensland man used a metal bike chain to assault his housemate after living arrangements became untenable, a court has heard.
Nicholas Bevington, 35, pleaded guilty in Gladstone Magistrates Court on November 13 to one count of assault occasioning bodily harm (domestic violence offence).
The court heard that on the morning of October 2, Bevington got into a verbal argument with the male victim - one of his two Gladstone housemates.
Police prosecutor Sergeant Merrilyn Hoskins said Bevington picked up a metal bike chain and swung it at the victim, hitting him in the back.
Sergeant Hoskins said when police arrived, the victim was “visibly shaken” and he had a laceration and swelling to his back.
“The witness told police that he saw (Bevington) assault the complainant with the metal bike chain,” Sergeant Hoskins said.
The court heard that Bevington had no criminal history.
In relation to the assault, solicitor Cam Schroder said the living arrangements became untenable and “an argument broke out.”
“He (Bevington) lost his temper - he is sorry for his actions,” Mr Schroder said.
The solicitor tendered two references for Bevington who works at a restaurant.
Magistrate Mary Buchanan fined Bevington $750 and no conviction was recorded.
