A remanded prisoner who was involved in a car crash before allegedly abusing hospital staff with an abusive tirade has been told to get legal advice because he was looking down the barrel of a jail sentence.
It was heard in the Gatton Magistrates Court that Mitchell Andrew Nielsen, who appeared via video link, was involved in a single-vehicle car crash on March 23, and denied having bloods taken when in hospital.
The 36-year-old initially pleaded guilty to one count each of driving without due care and attention, disqualified driving and failing to provide a specimen of breath, but when police prosecutor Narelle Lowe delivered the facts, Magistrate Graham Lee decided to adjourn the matter so Nielsen could obtain legal advice.
“Given your history, you’re looking at some form of imprisonment,” Mr Lee said.
“I’m going to have to give him the opportunity, Sergeant,” Mr Lee said to the bar.
Sergeant Narelle Lowe told the court Nielsen was driving in Goodna when he failed to negotiate a slight left-hand bend in the road.
“(He) veered across to the oncoming lane of traffic, striking a steel barrier and coming to rest facing oncoming traffic on the other side of the road,” Sergeant Lowe said.
Police attempted to interview Nielsen, who police say refused to participated and appeared to officers to be heavily intoxicated, reportedly slurring his speech and struggling to keep his bloodshot eyes open.
Nielsen allegedly refused to participate in either a roadside breath test or a blood test at Ipswich Hospital.
Sergeant Lowe told the court that once he arrived at hospital, Nielsen told hospital staff, “None of you c***s are going to rape me, that needle going into me is rape. You’re going to have to charge me then because I’m not letting you f*****g rape me.”
Magistrate Graham Lee read through Nielsen’s history, which included offences for failing to provide a specimen of breath, drink driving and unlicensed driving, before offering the Goodna man the opportunity to seek legal advice.
The matter was adjourned until July 12.
