A father of two has had his charge thrown out, despite pleading guilty to contravening a domestic violence order after he took the two boys from a park without informing their mother.
The man, who cannot be named for legal reasons, pleaded guilty to the charge in Hervey Bay Magistrates Court.
The court heard when the couple separated, they had two sons.
The couple verbally agreed the father would have custody of one of the boys and the woman would have custody of the other.
Arrangements were made to meet at a park so the two boys could play together.
When the mum briefly left the man with the two boys, he left the park with them without telling her, the court heard.
When the woman frantically tried to call the man on his phone, he ignored her then blocked her number.
Police were called and they contacted a friend who arranged for the boy to be picked up by his mother.
Magistrate Stephen Guttridge said he couldn’t see where there was an offence against the DVO in the statement of facts.
The charge against the man was struck out.
