Wayne Vincent Briggs sentenced in Chinchilla Magistrates Court after ‘stomping’ on employee’s head during dispute at oil site

A violent dispute broke out between an employee and the manager of a Western Downs oil business while on a worksite, with the argument ending in the employer stepping on the victim’s head as he left the scene. See what led to the shocking assault.

The manager of a Western Downs oil company ended an argument with an employee by “stomping” on his head after the pair had engaged in a “consensual” physical altercation earlier while on one of their worksites.

Wayne Vincent Briggs appeared in Chinchilla Magistrates Court on November 9 after he assaulted one of his former employees who became aggressive after learning about his mother and brother’s termination at the same company.

Police prosecutor Chris Hutchins said just after lunch time on July 3 the victim and former employee of Tango Oil Fuel Solutions became upset after receiving a phone call from his mum who had just been told she and her other son were terminated he went to “cool down” in a shipping container.

Sergeant Hutchins said Briggs, 51, went looking for the victim, where he was met with the man saying “you mother f--ker”.

The court was told the men engaged in consensual fight with the victim ending up on the ground outside of the shipping container.

As Briggs went to walk away, the court was told that the victim shouted ‘f--k you’.

“(The manager) turned around and stomped on the victim’s face once,” Sergeant Hutchins said.

Defence lawyer Brad Skuse said his client had initially gone to see the victim as he wanted to explain the termination of the man’s mother and brother but wanted to assure him he was not going to be fired due to him being a “good worker”.

Mr Skuse also said the manager claimed he only used a “moderate amount of pressure” when he placed his shoe over the man’s face.

“While the victim suffered injuries that was from what had transpired during the consensual altercation earlier,” Mr Skuse said.

The court was told the man was originally charged with assault occasioning bodily harm however it was downgraded to common assault due to the police not having enough evidence.

Briggs pleaded guilty to common assault and was fined $350.

No conviction was recorded.
