Dalby court wrap: Drug or unlicensed drivers sentenced

From a driver caught breaching road rules twice in one day to a driver who was found unlicensed after his car caught fire, these are the most recent offenders who faced the Dalby Magistrates Court.

A number of drivers have faced Dalby Magistrates Court for drug driving, or driving without a licence. Here’s what happened in court:

Samual Anthony Phillips

Phillips appeared in Dalby Magistrates Court pleading guilty to driving while on a suspended licence following an incident on October 2, 2024, in Kumbarilla.

The court was told about 3.10pm police attended a call-out to the Mooney Highway after reports a car had caught fire.

When they arrived they found Phillips next to his vehicle and following a licence check they determined he was unlicensed as well as being an L-plate driver.

Phillips was co-operative with police and told them he was on the way to pick up his father-in-law and was aware he had been suspended on July 27.

He was issued a one month loss of licence, $300 was added to his SPER and no conviction was recorded.

Michael Anthony Pohlmann

Pohlmann also faced court pleading guilty to driving while a relevant drug was in his saliva.

The court was told on August 2, 2024, police intercepted a black Holden on Showground Rd in Tara, issuing Pohlmann with an RBT where he returned a positive reading to methamphetamine and cannabis.

Pohlmann had appeared in court just days after the offence for a separate driving breach as well as in February the previous year.

He was subject to a three month loss of licence and $450 fine.

No conviction was recorded.

Rohan Ashley Stuart Lindsay

Lindsay appeared in court pleading guilty to providing false documents following an incident on March 28.

The court was told about 12.30pm in Dalby, Lindsay was intercepted by police who were conducting routine document checks on truck drivers when they discovered irregularities in his log book.

According to law heavy vehicle operators are not able to work more than 12 hours within a 24-hour period and the diary did not reflect the kilometres on the odometer.

Lindsay’s lawyer said his client, who was 61, had been driving trucks for 38 years and he estimated he had completed over six million kilometres without ever coming before the court.

Magistrate Kathleen Payne said the offending was out of character and said that “for someone who has been doing this for so long to have no traffic offences is impressive”.

He was fined $1260 and no conviction was recorded.

Oswald James Stanley

Stanley also faced court pleading guilty to driving with a drug in his saliva and driving while suspended after being caught twice in one day.

On June 28, Stanley was detected by police driving on Condamine St where he was issued an RBT returning a positive reading for methamphetamine.

He was also issued an on the spot suspension.

Later that day Stanley was again pulled over this time on Dalby Jandowae Rd in Jimbour East where police discovered he had been suspended earlier that day and had continued to drive.

He was issued a nine month disqualification and a $700 fine.

No conviction was recorded.
