An ‘enraged’ former concreter kicked in the door to a female friend’s home before brutally bashing her after she called him a name online.

A Bundaberg man with a lengthy criminal history pleaded guilty to an “enraged” and “unprovoked” attack on a friend in her own home.

Jayson David Walker pleaded guilty in the Bundaberg District Court to assault occasioning bodily harm and one count of burglary by breaking in at night with violence.

The court heard Walker had a lengthy criminal history since his first offence at the age of 23.

The ex-concreter has appeared in Queensland courts on 49 occasions for 99 charges; 20 of which resulted in time served behind bars.

Crown prosecutor Annica Fritz broke down Walker’s criminal history, which included four previous counts of assault occasioning bodily harm, assault of a police officer, domestic violence, public nuisance, common assault and a number of drug offences among others.

“He has repeatedly offended since he was first sentenced in the 90s,” she said.

“He has demonstrated no rehabilitation efforts in relation to his offending behaviour.”

The court heard Walker was under the influence of synthetic marijuana on April 13, 2022 when he saw a Facebook comment from a 50-year-old friend labelling him a “junkie”.

The court heard Walker was so “enraged” by the comment he drove to her home and began yelling, before kicking her front door open.

The court heard Walker then slapped his victim across the breast eight times, while she asked him “Jayson, what are you doing?” to which he replied “I’m not on f---ing drugs and I’m not a f---ing junkie”.

The court heard Walker then began punching his victim, first in the face three times, loosening a denture plate which caused his victim to gag.

During his attack, the door behind him closed, which he reopened.

“Then he punched her again, this time to the ribs and stomach,” Mrs Fritz told the court.

“She fell over on the floor and hit her head, and he came over and put this hands around her throat but did not restrict her breathing.”

The court heard Walker’s victim shouted his named before telling him the police were on their way.

“Walker said words to the effect of ‘you can call the police, I’m not scared,’ (then) he let her go then walked out of the house,” Mrs Fritz said.

The victim received a number of abrasions as a result of the attack, though she did not make a formal complaint until June 3, 2022.

The court heard police located Walker on July, 27, 2022 where he was then arrested and charged and served 189 days in presentence custody.

Barrister Jens Streit told the court Walker accepted the “unacceptable” nature of the offences and had been under the influence of a drug he had not tried before.

“He was angry greatly, and said he couldn’t get those comments out of his head,” he said.

Mr Streit told the court Walker showed restraint by not choking his victim and had intentions of addressing his drug issues once released on parole.

Judge KC Allen did not accept the defence that Walker had acted violently as a result of an adverse reaction to a new type of drug.

“I note that you’ve got a criminal history of violent offending over many years,” he said.

“This offending cannot be explained away by the consumption of the drug.”

Mr Allen told Walker he had caused his victim psychological as well as physical harm.

“The offending was against a vulnerable woman which had shown you support and hospitality in the past. It was disgraceful, gratuitous, mindless violence.”

Walker was sentenced to two years and six month jail for assault and 18 months for burglary, with a parole date set for August 5, 2023.

Convictions were recorded.
