A married prison guard grabbed a woman on the bum and told her she had a “nice a--” before exposing himself in a beer garden after attending a funeral.
Corrective Services officer Matthew Paul Johnson, 38, of Blue Haven, faced Downing Centre Local Court on Tuesday where he applied to have two charges of sexual touching and wilful exposure dismissed under mental health laws.
It comes after Johnson pleaded guilty to the offences in Wyong Local Court in January.
An agreed set of facts states Johnson had been at a funeral in August 2023 before attending a wake at the Doyalson Wyee RSL.
He was drinking beer and socialising with other funeral guests when he approached a female acquaintance at the bar and “put his nose and face into the right shoulder of the victim”.
“You smell so f--king good, why do you smell so good?” Johnson asked the woman.
“The victim said to the accused ‘What the f..k are you doing’. The victim stepped away from the accused and put her left hand up in a stopping motion.”
A short time later Johnson was in the smoking area of the beer garden when he “approached the victim and grabbed the victim on the buttocks”.
“As he did so he said, ‘You have a nice arse’,” the facts state.
“The victim told the accused to ‘f--k off’. When she did this the accused let go of her and walked away.”
Later in the evening Johnson, the victim and others were in the same area of the beer garden when Johnson exposed himself.
“The accused removed his penis from his pants and while holding it in his right hand starts to swing his penis around in an anticlockwise direction,” the facts state.
“Both the victim and the other female witness described the action as a circular motion.”
The incident was captured on CCTV.
Four months later in December, 2023, Johnson attended Wyong Police Station where he was arrested and interviewed.
He denied sexually touching the woman.
“The accused did admit to removing his penis from his pants and swinging it around but claimed the only person who could have seen it was [another man],” the facts state.
“When shown the footage he agreed that both [the victim] and [the other man] would have seen it but no one else did so did not believe there was any problem with his behaviour.”
Johnson appeared before Deputy Chief Magistrate Michael Antrum who dismissed the section 14 mental health application and dealt with Johnson at law.
He convicted Johnson of both counts and fined him $330 for wilful exposure and sentenced him to a conditional release order for nine months for sexual touching.
One of the conditions of the order is he participate in any program, treatment or intervention specified by Community Corrections.
A Corrective Services spokesman said Johnson, who had been suspended on full pay pending the outcome of his legal proceedings, had resigned in August last year.
