Adelle Rubino pleads guilty to high range drink driving offence

A woman told officers to take her into custody when they found her crying in her car, parked outside a police station, with a drained bottle of Wild Turkey next to her.

A North Gosford woman told police to “just arrest me” when she was found crying in her car with a drained bottle of Wild Turkey next to her.

Adelle Rubino pleaded guilty to high range drink driving in the Gosford Local Court on Tuesday and was disqualified from driving for six months.

Officers found Rubino parked in a police-only car park out the front of the Gosford Police Station after 11pm on November 28 last year.

According to court documents, Rubino was sitting in the driver’s seat with the keys still in the ignition.

When police approached her she said: “just arrest me”.

Rubino was “crying” and “very upset” but would not respond to the majority of the police questions about where she had come from and why she was parked outside of the police station.

Rubino admitted to police that she had consumed alcohol, was taken into custody and returned a reading of 0.157.

Police suspended her licence and offered her a lift back to her address and also offered to call a taxi, however Rubino declined.

According to police facts, officers noticed Rubino walk outside and back towards her car where she became aggressive after being handed a suspension notice.

Police then confiscated Rubino’s car keys.

“The accused began yelling about how it is disgusting that police made her walk home at night despite being offered a lift or a taxi,” police facts state.

Rubino represented herself in court and made written submissions asking for her matter to be dismissed.

Magistrate Peter Railton said on this occasion Rubino was very well affected by alcohol and made a deliberate decision to drive.

“You still exposed other innocent members of the community to potential death or danger by reason of the fact you are not fully capable of driving a motor vehicle,” he said.

“I accept there’s personal subjective material which you put before the court, some which seems quite weird to me.’’

A conviction was recorded but no financial penalty was imposed.
