Monsoons bouncer Hayden Summers accused of causing unlawful harm after knocking out US marine

Dramatic footage showing the moment a US marine was knocked to the ground outside a popular Darwin nightclub has been released.

The CCTV footage, played to Darwin Supreme Court, shows security guard Hayden Robert Bruce Summers and marine Glen Thomason outside the Monsoons nightclub in the early hours of April 11, 2021.

Summers has pleaded not guilty to unlawfully causing Mr Thomason serious harm after the court heard he knocked the man out with a single blow outside the nightclub.

The trial is entering its closing stages.

In the footage played to the court on Wednesday, Mr Thomason is seen allegedly yelling, “I’m a trained killer, I will kill you” at the bouncer.

The footage shows Mr Thomason make a movement with his arm towards Summers.

As the incident escalates Mr Thomason is shown to make a swipe at Summers’ head, but does not make contact.

The bouncer retaliates and strikes the marine knocking him out and sending him to the ground with a single blow.

In his closing statement, Crown prosecutor Ian Rowbottom referred to CCTV footage of the incident, calling the bouncer’s actions unjustified.

“The blow that struck Mr Thomason was unlawful in that it wasn’t authorised and it wasn’t justified,” Mr Rowbottom sad.

“One punch can kill. That was a risk and that man was prepared to take that risk.

“It could have killed Thomason, but it didn’t, thankfully, because of medical intervention.

“He did not deserve that to happen to him, he did not deserve force to be applied, he may have deserved a push, but he did not deserve a blow like that which knocked him out cold.”

Summers’ defence barrister, Peter Maley called on the jury to consider Summers had acted in self-defence and had otherwise acted in a calm manner.

“All of the witnesses gave unchallenged evidence that the US marine was aggressive and engaged in confronting behaviour,” Mr Maley said.

“They all say the marine would not leave or calm down and that he yelled and screamed.

“They all recalled him saying words to the effect of “I could kill you, I’m a trained killer, I’m a US Marine. The Crown didn’t suggest that was fabricated or made up.

“Every witness without exception says Hayden was calm and trying to defuse the situation and he didn’t lose his temper.

“Clearly it was a forceful slap, but the marine was not punched with a clenched fist or a big haymaker or kicked and there’s no weapon used.

“This was unplanned and spontaneous. Remember a pre-emptive strike is still self-defence, you (don’t) have to wait to be punched in the head before you can respond.”

The jury will resume their deliberations on Friday.
