A TOOWOOMBA man's main regret after a police search found marijuana in his home was that he hadn't smoked it before they arrived, the city's Magistrates Court has been told.

Luke George Dawe was found to have a 20cm marijuana plant growing in a pot when police search the Stenner St residence he was at on October 13, last year, the court heard.

When police found a small amount of "green leafy material" on a plate near the sink, the 39-year-old told police it was marijuana "about two cones worth", police prosecutor Al Windsor told the court.

"He said if he'd known the police were coming he would have smoked it first," Senior Constable Windsor said.

Dawe admitted to having planted marijuana seeds in the pot and had watered for the previous months.

He pleaded guilty to producing and possessing a dangerous drug, a pipe for smoking the drug, contravening a police direction and to receiving a mobile phone that had been reported stolen.

Dawe had pawned the mobile phone at a second hand shop in Toowoomba for $100, later telling police he had bought it at a garage sale but couldn't remember where.

He told police the garage sale had been somewhere between Toowoomba and Maryborough, Snr Const. Windsor told the court.

Defence solicitor Phil Stainton said his client had started drinking heavily and smoking the drug after separating from his partner 18 months ago but he had since got his life back on track.

Magistrate Damian Carroll placed Dawe on 18 months probation to include random drug testing and fined him $300 for contravening the police direction.
