Jason and Kerrie Struhs face Toowoomba Magistrates Court as murder case continues

The couple accused of murdering their daughter, Elizabeth Rose Struhs, by allegedly refusing lifesaving medication, have faced court.

The couple accused of murdering their own daughter by allegedly refusing to provide lifesaving medication on religious grounds have again faced court.

Jason Richard Struhs and Kerrie Elizabeth Struhs both faced Toowoomba Magistrates Court on Thursday when their matter was mentioned.

The couple are accused of withholding medication required by their daughter Elizabeth Rose Struhs, with police alleging the eight-year-old girl died in her Rangeville home sometime between January 7-8.

Police and paramedics were alerted to her death on the afternoon of January 8, 2022 after the Struhs family and members of their ad hoc church allegedly gathered to pray for Elizabeth’s recovery.

Police will allege Mr and Mrs Struhs opted for prayer over medical treatment and that Elizabeth died as a result.

They both face one charge each of murder, torture and failing to provide the necessities of life.

Mrs Struhs, appearing from Brisbane Womens Correctional Centre and Mr Struhs, appearing from Brisbane Mens Correctional Centre, both confirmed they were self-representing for the matters, and neither entered a plea to the charges.

Both accused confirmed to the court that they had received the police brief of evidence, but that they had not read it.

“I won’t be considering the material,” Mrs Struhs said, while Mr Struhs said he was “probably not” going to look at it.

Acting magistrate Roger Stark told the couple that it was in their “best interests” to seek legal advice on the charges and to read the material.

Mr Stark reiterated that the couple had a right to file applications to cross examine any witnesses in the matter, but if they did not take part in any directions hearings the matter would proceed via a hand-up committal, with the evidence to be presented to a magistrate to decide if it should proceed in a higher court.

The pair made no application for bail and were remanded in custody to appear in Toowoomba Magistrates Court again on July 28, 2022.
