Brutal bottle shop stabbing captured on CCTV

A misunderstanding over a some booze and a lift to a party ended in a man being stabbed several times while he was in the drive-through of a bottle shop, a court has heard.

Jake Yates appeared in the Supreme Court on Monday after pleading guilty earlier this month to causing unlawful serious harm.

About 6pm on January 24, 2021, Yates and his girlfriend drove from a friend’s house to the Palmerston Tavern to pick up Andrew Burai and drive him to a social function, the court heard.

Yates was told by the friend he would be given alcohol or fuel by Mr Burai as payment for the ride.

However, Mr Burai was not aware of the agreement and refused to buy Yates alcohol, causing an argument while the pair were waiting to be served in the drive through of the bottle shop at the Palmerston Tavern.

Yates asked Mr Burai to get out of the car before a fist fight broke out inside the vehicle.

Outside of the car, the fight continued with the man punching Yates in the face.

CCTV footage of the incident, released by the Supreme Court, shows Yates picking up a knife off the ground before stabbing Mr Burai several times in the arms and body.

Mr Burai survived the shocking assault but died in a car accident at Howard Springs, .

Crown Prosecutor Russell Hammill said it was unclear who the knife belonged to.

Yates’ lawyer, Jon Tippett, argued against CCTV of the incident being released, telling Chief Justice Michael Grant footage of an unrelated incident has been used as “trauma porn” in the past.

“Just like pornography only with violence,” he said.

Yates, drove away, leaving Mr Burai bleeding on the ground.

Mr Burai was tended to by two off-duty Defence Force combat medics who witnessed the incident while waiting in line.

The footage shows the medics administering first aid to Mr Burai while blood pools in the drive-through before emergency services arrive.

Mr Burai had emergency surgery and was placed in an induced coma.

When police arrived at the friend’s house to arrest Yates, who was serving a suspended sentence at the time, he jumped a back fence and cut the electronic monitoring device off his ankle before being arrested five days later.

Mr Tippett said it was not Yates’ intention to continue the fight after the first few punches were exchanged outside the car.

“He’s walking back but ultimately gets to a point where he uses the weapon,” Mr Tippett said.

“He just wanted to go about his business.”

He said Yates was defending himself against “a man intent to the very end to continue to try and hurt him”.

Yates was remanded in custody until his sentencing on October 28.
