Lily Jade De Las Heras: Woman on parole spits and punches disabled woman at Labrador units

A 23-year-old woman who previously hit a 61-year-old with a spanner is behind bars after she spat on and hit a disabled woman. Read what happened here.

A 23-year-old Upper Coomera woman who had been sentenced for hitting a 61-year-old with a spanner last year is behind bars after she spat on and hit a disabled woman.

Lily Jade De Las Heras appeared from custody via videolink in the Southport Magistrates Court on Wednesday where she pleaded guilty to assault occasioning bodily harm.

The court heard a 55-year-old woman who suffers from severe osteoarthritis was walking up the driveway to her unit in Labrador with her shopping and walking stick around 2pm on February 20, when she noticed a man at a unit having a medical episode.

The woman attended the unit and asked De Las Heras if she knew the man.

As the woman walked to her unit through the carpark, De Las Heras followed her, yelling “get the f*** out of here” and threatening to hit her if she didn’t leave.

The woman told De Las Heras she would call the police if she hit her.

The court heard De Las Heras told the woman “you’re lucky I’m keeping my cool at the moment, I’ll bash the cr** out of you.”

She blocked the walkway towards the woman’s unit before spitting in her face.

The woman hit De Las Heras’ leg with her walking stick to get her to move and allow her to enter her unit.

De Las Heras continued yelling and spat on the woman again as she was walking past.

A male friend of De Las Heras stepped between the two and held her back but it didn’t stop De Las Heras from obstructing the woman’s path and punching her with a closed fist.

Neighbours who came outside to help the victim allowed the woman to flee to her unit and lock her security door.

Still, De Las Heras continued to threaten her through the security door.

The woman and neighbours called police but De Las Heras fled by the time they arrived.

The woman suffered a bloody nose from the punch and had to attend a medical centre to receive treatment.

The next day, police located De Las Heras at a unit where she tried to close the door on police and made attempts to resist arrest.

De Las Heras had been sentenced in the Beenleigh District Court in May last year to a term of imprisonment with immediate parole after she hit a 61-year-old Boronia Height man with a spanner and attempted to steal his car.

Following her arrest this year, the Assisi Catholic College alumnus was back in custody with her parole set for April 2027.

Her defence lawyer Daniel Gilbert from Gatenby Criminal Law, told the court De Las Heras’ friend was overdosing on GHB at the time of the offence, and she was acting protectively of her friend.

The court heard De Las Heras had been kicked out of home at the time of the offence due to her relapsing.

Mr Gilbert said De Las Heras’ mother, who was in court, condemned her actions but would support her upon release.

He added that De Las Heras, diagnosed with ADHD and PTSD, was remorseful and sought to make drastic changes in her life.

Magistrate Joan White took into account De Las Heras’ letter of remorse to the court and said she had had time to reflect on what went wrong.

“You were doing so well with your life and it all went pear shaped as a result of you recommencing a friendship, which is very very sad,” she said.

Ms White noted De Las Heras made admissions to the offence but said it didn’t excuse her.

She took into account three and a half months De Las Heras has already served in custody.

Ms White sentenced De Las Heras to three months in prison with the parole eligibility date set for the same day.

She said as there was no definitive conclusion for when De Las Heras would be released, she was not in a position to pay compensation to the victim either now or in the near future.
