A former burger shop owner, who is currently serving time behind bars for tormenting a woman for years, was busted drink driving almost three times the legal limit.
Joshua John Plozza, 32, fronted the Geelong Magistrates Court via video link from custody on Wednesday and pleaded guilty to drink driving.
In July this year, Plozza was sentenced to two months in jail after pleading guilty to stalking.
He owned JP’s Drive Thru on Yarra St, which has since closed its doors.
The court heard on May 9 this year about 12.10am, officers saw Plozza driving and swerving across multiple lanes in Geelong.
Police intercepted the vehicle and Plozza produced a full driver’s licence.
A preliminary breath test detected alcohol in Plozza’s breath.
Plozza was taken to Geelong police station where he was again breath tested and returned a BAC reading of 0.143, almost three times the legal limit of 0.05.
The court heard during a police interview, Plozza appeared “flippant” and “ignorant”, showed little remorse and refused to answer questions.
Plozza told police he believed he was under the legal limit, the court heard.
Plozza’s lawyer, Simon Northeast, said his client had previously lost his license in 2011 for speeding.
Mr Northeast said Plozza was drinking with others, who were in the hospitality industry, prior to the offending.
He said Plozza was moving his car 200m down the road to his workplace.
Judicial register Michael Bolte told Plozza he should have been “well aware” he was over the legal limit.
“Driving at 0.143 puts innocent members of the community at risk, no matter how far you’re driving,” he said.
Mr Bolte fined Plozza $1000 without conviction and he was disqualified from driving for 12 month.
