Wymer, 29, was seated beside a learner driver when their vehicle was pulled over by a police patrol on the Warrego Hwy at Withcott about 10.10pm, December 14, Toowoomba Magistrates Court heard.

While the driver blew a zero reading, Wymer told police he was supervising the L-plater.

Police then breath-tested him and he blew 0.13, police prosecutor Greg McIntyre told the court.

It was discovered Wymer had not been sentenced for an outstanding drink-driving matter dating back to March 17, last year, the court heard.

On that occasion, Wymer had crashed the vehicle he was driving on the Gold Coast and blood sample taken from him at Southport Hospital showed he had a blood/alcohol reading of 0.175.

Wymer told police he had driven from Toowoomba after an argument with his mother.

His solicitor Brad Skuse said his client's driver's licence should have been cancelled then due to the high reading but, possibly due to confusion in having the blood test analysed, Wymer legitimately had his driver's licence when the car he was in was pulled over at Withcott on December 14.

Magistrate Damian Carroll fined Wymer $2000 and diqualified him from driving for 22 months.
