Top Toowoomba developer Barry Bernoth requests extension for industrial subdivision approval

An approved industrial subdivision, put forward by a major Toowoomba developer, will need more time to start construction due to the impacts of the COVID-19 pandemic.

A major Toowoomba developer has requested more time to develop an industrial subdivision in the city’s western suburbs, citing the impacts of COVID-19 on the decision.

Barry Bernoth was approved in 2017 for a 21-lot subdivision in a community title scheme on nearly six hectares of land on Robson-Hursley Rd in Torrington.

The original plans were designed to let individual tenants develop the lots for a range of industrial and storage uses.

“It is anticipated that each individual tenant will need to apply for a development permit for a material change of use before commencing operation,” the original planning report said.

But JFP Urban Consultants this week sent a letter to the council’s planning department, requesting an extra two years to ensure the development could be started.

“Our client seeks the council’s agreement to extend the currency period of this approval for an additional two years from the current relevant period date; the proposed currency period being until 16 May 2023,” the letter said.

“This extension is sought to enable the applicant enough time to complete the proposed development.

“Unfortunately, a number of circumstances and external considerations have delayed the commencement of the development, including the commercial/financial impacts of COVID-19.

“These issues necessitate and warrant a further extension to the approval.”

The extension application is currently under assessment with the council’s planning officers.
