A set of new units could be coming to a residential street in an inner-city Toowoomba suburb, after plans were submitted to the council this week.
Applicant McAllister Group Pty Ltd put a new proposal for a set of five two-bedroom single-storey units on Whichello Street in Newtown.
The application comes two years after a similar project was approved by the council for the same block of land.
But according to the report by Precinct Urban Planning, a new application was needed because the council’s planning scheme had changed since that previous approval.
The new application features a change to how stormwater is moved off the site.
“As a consequence of amendments to the Toowoomba Regional Planning Scheme 2012 that occurred in late 2019, the applicant was not able to make a change application for a “minor change” under the Planning Act 2016 to amend approved stormwater management arrangements,” the report said.
“The development seeks to capture and discharge stormwater to the street network as opposed to the current approved arrangements of discharging through neighbouring properties by way of a drainage easement.
“The change has arisen as a consequence of the neighbouring land owner no longer agreeing to the establishment of drainage easements over the adjoining land.”
The council has yet to respond to the application.
