Clifton Mill development approval appeal dropped by appellant

A CLIFTON man who took Toowoomba Regional Council to court over its approval of contentious development application for the Clifton Mill has discontinued his legal action.
Russell May appealed to the Planning and Environment Court in early July after the council approved a DA for the mill.
According to documents filed with the court by his solicitors late last month, Mr May gave notice that he was discontinuing his appeal.
The mill, currently owned by Ridley Agriproducts, was operating on the Mary St site for decades before TRC officers discovered in late 2018 it was operating without proper approvals.
On June 3, TRC gave notice to Mr May it had approved the development application and provided him with a copy of a negotiated decision notice.
Mr May was appealing against the mill on a number of grounds, including that it was an inappropriate use for the low impact zone, and would result in unacceptable impacts on existing residential uses.
