Cairns crime: Son of attempted murderer jailed for horrific sex attack on impaired teen

A man whose own father died in jail because of his violence toward women was sentenced after being found guilty on three of four charges over the prolonged assault of an impaired 16-year-old.

A man whose own father died in jail because he nearly killed his former partner has been jailed for raping an impaired 16-year-old girl.

A tragic cycle of intergenerational violence was laid bare when a jury found the son of a man who died while serving time for a ferocious knife attack on his former partner was found guilty on three serious sex offences at the end of a four-day Cairns District Court trial.

William Michael Mallie, 41 from Cairns, pleaded not guilty to sexual assault, and three rape charges.

A jury found him guilty on three charges but not guilty on rape – carnal knowledge without consent, with Judge Dean Morzone KC noting “doubt had arisen in relation to scientific evidence about the presence of DNA”.

Mallie’s father, also named William Michael Mallie, died of a heart attack in 2016 in Lotus Glen while serving a 10 year sentence for attempted murder – the sentence was originally eight years but was increased to 10 years on appeal.

He had attacked a 40-year-old woman with two fishing knives.

Crown prosecutor Rachel Boivin said it was a violent and relatively prolonged attack by Mallie Jnr on May 14, 2021, and the girl feared for her life as she was being choked.

It started with Mallie grabbing her by the bottom and making unwanted sexual comments, before he pulled her into nearby bushes, held her down, put his hand over her mouth, choked her and told her to shut up or he would “pound her head into the ground”.

Ms Boivin said Mallie forced the girl to her knees and horrifically sexually assaulted her.

Defence barrister Anthony Collins said Mallie’s father was an extremely violent man and he was brought up in circumstances of extreme domestic violence.

He raised the issue of whether the girl was corrupted by the offending, saying she had used social media in 2020 and 2021 to display sexual images of herself and had sexually explicit conversations with older males.

“In my submission, whatever happened that night happened quickly, he walked all the way with her to her house, a 35 minute walk,” Mr Collins said.

But Ms Boivin said the girl was vulnerable by the very nature of the age difference between them – she was 16 and he was 41 – and she was no less vulnerable because she had a troubled upbringing.

The court heard he made disgusting remarks like “I can’t wait to shove my d***” to the girl, who was screaming before she was ordered to her knees.

Judge Morzone noted Mallie had breached a suspended sentence and that he had 938 days in custody ahead of trial.

He handed down a head sentence of six years with a parole eligibility date of March 14, 2024, with 938 days declared as time served.
