A driver has been mercilessly mocked after complaining about a steep fine he received for using his phone behind the wheel.

The Queensland motorist was busted by a fixed mobile phone camera while stopped at a set of lights on Mains Road in Macgregor, south of Brisbane, just after 6pm on January 20.

He was pictured inside his BMW holding what appeared to be his phone, and was subsequently slapped with four demerit points and a $1033 fine.

The penalty slip and incriminating photos were shared in a video uploaded to TikTok earlier this month, which saw the driver receive a whole lot less sympathy than he possibly expected.

“This is straya mate,” he captioned the video, which has been viewed more than 300,000 times and attracted close to 500 comments, many from people poking fun at him.

“No sympathy. Everyone knows the rules,” one comment read, with another writing: “Don’t use you’re phone why driving. it’s pretty simple”.

Someone else asked, “are you seriously confused?”, while another said, “You absolutely deserve it.”

One was shocked the driver didn’t see the mobile phone camera at the lights given it was fixed, which led him to confess he had been using his phone while stopped at a red light.

“It was red light and I thought that would be OK,” he wrote.

Others agreed it was difficult to miss the camera that caught him out.

“I don’t know how you can miss the phone camera on Mains Road. It sticks out like a sore thumb,” one said.

“Bruh how can you miss that camera though,” another said.

Penalties for using a device behind the wheel are particularly steep in both Queensland and Western Australia, where the offence carries a $1000 fine and four demerit points.

In NSW, the offence carries a penalty of five demerit points and a $352 fine, increased to $469 in a school zone, and in Victoria, four demerit points and a $545 fine.

In Tasmania, drivers are hit with a $300 fine and three demerit points, and in South Australia it’s $534 plus $60 victims of crime levy, plus three demerit points.

Drivers in the Northern Territory face a penalty of a $500 fine and three demerit points, and in the ACT, $470 and four demerit points.
