Jarryd Hayne denies allegations of sexual assault in 2015
Court documents reveal details of rape accusations levelled against Eels recruit Jarryd Hayne by a woman in the US, as the NRL speaks on his likely playing situation.
Parramatta Eels recruit Jarryd Hayne has strenuously denied sexually assaulting a woman in the United States in 2015, while playing in the NFL for the San Francisco 49ers.
Hayne released a statement through Madison Marcus Law Firm on Wednesday afternoon.
“We act for Mr Jarryd Hayne. We are instructed to issue the statement below: Mr Hayne and his management are aware of recent media speculation in relation to a civil complaint filed in the United States of America making certain allegations in relation to an event which allegedly occurred in 2015 whilst playing for the San Francisco 49ers,” the statement read.
“Mr Hayne has not been served with any proceedings or formal complaint relating to the incident.
“Mr Hayne previously addressed a complaint made to the District Attorney’s office in the County of Santa Clara, California in 2016 and the District Attorney did not proceed any further with the matter due to insufficient evidence to substantiate the allegations. Mr Hayne provided all reasonable assistance to the District Attorney with that investigation.
“Mr Hayne unequivocally and vehemently denies the allegations which are the subject of the civil complaint. Mr Hayne will not be making any further comment in relation to this matter.”
Hayne stands accused of raping a woman in the United States while playing with the 49ers, with the NRL to monitor the situation before taking any action regarding his playing future.
Civil court documents filed in a Californian court claim the incident took place in December, 2015, just months before Hayne ended his stint in the US to link up with the Fijian Rugby Sevens side.
The matter wasn’t brought forward to the police until May, 2016, the same month Hayne departed the 49ers.
In the statement of complaint, the plaintiff says she didn’t immediately report the incident to authorities because she feared being discredited or blamed. Instead, she asked a friend to speak with Hayne and when he reportedly said “nothing had happened” she contacted him direct via Instagram. He then admitted they’d “hooked up”.
The case is being dealt with as a civil matter after it was reviewed by the District Attorney’s Office in October, 2016, and rejected due to insufficient evidence.
The woman had previously met some of Hayne’s friends when working at a local restaurant and they all caught up after a 49ers game, documents lodged in a County of Santa Clara court state.
The documents say Hayne later took the woman, who isn’t named, home in a Uber and she passed out in the car “due to her extreme level of intoxication”. The victim says she was a virgin at the time of the alleged attack. Her lawyer, John Clune, says at the time his client was “unable to consent to sexual intercourse”.
“Mr Hayne brought our client back to his home, approached her in the dark, turned her around as to not face him and told her ‘no kissing’,” Mr Clune said in a statement.
“He then had non-consensual sexual intercourse with her.” The court documents reveal the woman took Hayne’s “undergarment” after the alleged rape in case she needed proof of the incident.
An NRL spokesman said the governing body’s Integrity Unit will continue to monitor the case, with a playing ban believed to be unlikely.
“We note that the police in the United States did not proceed with any criminal proceedings but we will review the information available and continue to monitor the civil case,” a spokesman said.
Eels chairman Max Donnelly said the club was unaware of the allegations until today, Hayne not stood down by his new side.
“As with any legal matter, it is important that we follow due processes and ensure that we review all relevant information as it becomes available, including giving Jarryd the opportunity to respond,” Donnelly said via a statement.
“The club will continue to monitor the situation and when appropriate we will provide an update.”
It is understood Hayne denies any wrongdoing.
The 29-year-old signed a one-year deal to re-join the Eels earlier this month after 16 months at the Gold Coast Titans.
