Virginia Giuffre, who on Tuesday “mistakenly” claimed on Instagram that she was dying, has been charged with breaching a family violence restraining order, it has emerged.

Late on Wednesday, Ms Giuffre was in a stable condition at Perth’s second-biggest public hospital – Sir Charles Gairdner Hospital. She had arrived there in the early hours of Tuesday by ambulance from the semi-rural area of Neergabby, 70km north of Perth. She is due to face a hearing next month in the Joondalup Magistrates Court.

Ms Giuffre recently separated from her husband, Robert. In recent months they have each faced court on separate matters.

In multiple social media posts, Ms Giuffre has expressed her wish to see her children and she repeated that wish in her Instagram post in which she suggested she could die happy if she could see them again.

The post was published alongside a selfie of Ms Giuffre’s bruised face and her announcement that her death was imminent. She appeared to be in a hospital bed, but the timing of the post suggests she may have been en route with paramedics in a St John of God ambulance.

Ms Giuffre entered headlines worldwide as a victim of notorious trafficker Jeffrey Epstein, who allegedly provided her to his friend, Prince Andrew. She alleged Prince Andrew sexually abused her in 2001 when she was 17. The Duke of York has always denied this but settled the matter with Ms Giuffre in 2022 with a payment reported to be $24m.

On Wednesday Ms Giuffre’s spokeswoman, Dini von Mueffling, said Ms Giuffre had issued the emotional Instagram post by mistake, and that it was supposed to go to a private Facebook account.

However, Ms Giuffre did not resile from her claim that she was dying from kidney failure, and her agent said in a statement she was in a “serious condition”.

Amid confusion over the state of her health, the Sir Charles Gardiner Hospital said her condition was “stable”.

Ms von Mueffling did not respond to a query about her alleged breach of a family violence restraining order by late Wednesday.

Ms Giuffre’s husband was in a Perth court last month on one charge of inadequately storing a firearm and was handed a spent conviction. Late last year, Mr Giuffre pleaded guilty to reckless driving at a speed that was more than 45km/h above the speed limit. His licence was suspended for six months and he was fined $1200, plus $350 costs.

Ms Giuffre’s original Instagram post claimed she had been given days to live after a school bus travelling at 110km/h struck her vehicle as she was slowing for a bend.

Police have confirmed Ms Giuffre was a passenger in a car that collided with a bus on March 24. Nobody was hurt.

In a statement, Ms Giuffre’s agent said she was “overwhelmed with gratitude” for the public’s support.

“Virginia thanks everyone for the outpouring of love and support. She is overwhelmed with gratitude,” the agent said.

“Today she remains in serious condition while receiving medical care. On March 24, in rural Western Australia, a school bus hit the car in which she was riding. The police were called but said that there was no one available to come to the scene.

“They asked if anyone was injured and suggested that if they were, they should make their way to the hospital. The school bus driver had a bus full of distraught children and left the scene to get them back, saying he would file a police report, which he did later.

“Virginia was banged up and bruised and returned home. Virginia’s condition worsened and she was admitted to the hospital.

“Concerning her Instagram post, Virginia thought that she had posted on her private Facebook page. Virginia and her family thank everyone for their concern.”

In her Instagram post, Ms Giuffre wrote: “I’ve gone into kidney renal failure, they’ve given me four days to live, transferring me to a specialist hospital in urology. I’m ready to go, just not until I see my babies one last time, but you know what they say about wishes.”

Ms Giuffre’s father Sky Roberts told the UK Telegraph he was hoping she could obtain another medical opinion with different prognosis.

“She’s not doing good,’’ he told the Telegraph.

“She’s depressed because she misses her kids. She’s got four days unless she gets another opinion from another doctor.

“It could be that she could pass away in four days, like she said. But if she gets another doctor, they could probably do other things for her. So that’s all I’m waiting to hear.

“It’s terrible, I want to cry and everything else, but I want to stay strong for her just in case she needs something. Then I’ll be there for her.’’
