The 55-year-old is set to appear in a Mullumbimby court next month, charged with two offences.
The offences are “attempt to drive while under influence of alcohol – first offence” and “drive vehicle under influence of alcohol – first offence”. He does not have bail conditions attached to the charges.
Mr Baker is nominated for a TV Week Logie Award on Sunday for his role in Boy Swallows Universe.
The hit Netflix series, starring Mr Baker, is nominated for a staggering 11 awards – the most out of any other actor or show.
It was reported in 2022 Mr Baker split with his wife Rebecca Rigg after over 20 years of marriage.
The global television star owns a property at Nashua in the NSW northern rivers, in between Lismore and Byron Bay, jointly owned with Ms Rigg, also an actress. It is understood the property was purchased several years ago but only transferred into their names as a 50-50 share in October last year.
The couple also sold their Bronte home in 2021 for close to $17 million, after purchasing it for just $6.5 million for the almost 380 square metre property in 2015.
It was been reported the former couple previously purchased a Lennox Head property to give their three children – who were raised in Los Angeles – an experience in the Lennox Head community.
Mr Baker is best known for his portrayal as Patrick Jane who would use his uncanny intuition to solve crimes in hit television show The Mentalist, which earned him a star on Hollywood Walk of Fame in 2013.
He will appear before a magistrate at Mullumbimby local court on September 4.
