Bike boss Toby Mitchell’s court bid to attend Australian Open

A bikie boss has come back to court with one request after slapping a man at a pub during a booze-fuelled birthday bash.

Bikie boss Toby Mitchell will not be allowed to attend this year’s Australian Open after his ­request for a bail variation was turned down.

The 47-year-old is on bail after slapping another man during a drunken night out at a pub in the Victorian border town of Echuca last year. He was sentenced to two months behind bars but granted bail appeal. Mitchell intends to appeal his sentence and conviction.

Mitchell appeared via video link in Victoria’s County Court on Monday where his lawyers asked to remove the condition that he not attend a licensed premises where alcohol is served – which includes restaurants and events such as the Australian Open.

Prosecutors argued that the variation should not be granted, citing three alleged incidents over 14 months where Mitchell was accused of assaulting people after attending a licensed venue, or coming into contact with ­people who had.

“We want to remove the risk completely,” prosecutors told the court, citing concerns he might be “tempted” to drink.

Mitchell is a tennis fan who shared two Instagram images on Monday of Novak Djokovic leaving Australia.

Judge Kate Hawkins said it wasn’t so much a concern that the Mongols boss was intoxicated, but that the alleged incidents occurred with members of the public who may have been intoxicated.

“There does seem to be some correlations to the alleged offending occurring in the context of people drinking in licensed premises,” she said.
