Bankruptcy bid against Guy Sebastian ex-manager Titus Day

Pop star Guy Sebastian’s former manager Titus Day has had bankruptcy proceedings launched against him after a jury found him guilty of embezzling more than $600,000.

The 50-year-old was jailed for a minimum of 2½ years, and is now being pursued by his solicitor for $472,528.46 in unpaid fees.

Day is appealing the findings and has been released from custody while the appeal is on foot.

Andrew Michael O’Brien, of O’Brien’s Solicitors, acted as Day’s solicitor before and during the trial in the NSW District Court in 2022, with the fees being sought also constituting counsel fees.

The application for the sequestration orders were filed in the Federal Circuit and Family Court on September 5.

In June last year, a District Court jury convicted Day on 34 of 47 charges relating to the embezzlement of more than $620,000 of the pop singer’s earnings.

He was found not guilty of 13 charges.

Day was sentenced by judge Timothy Gartelmann in November last year to a maximum of four years in jail and ordered to pay more than $620,000 to Sebastian.

However, Day was released from custody in June after his barrister, Bret Walker KC, argued in the Court of Criminal Appeal he should have his conviction quashed on three grounds.

One argument was that the prosecutor reversed the onus of proof by referring to the “absence of Mr Day as a witness” during the trial in his closing remarks, therefore causing a miscarriage of justice.

The NSW Supreme Court confirmed the court was “satisfied” one of the grounds of appeal had been made and he was given bail.
