The outcome of a legal spat between Boral and construction materials minnow Wagners will remain under wraps for a further two weeks after the Supreme Court of Queensland ordered a judgment remain confidential until June 4.
Wagners halted trading on Tuesday ahead of an expected decision by the court over its year-long stoush with Boral.
However, Justice John Bond said the judgment was tied by a confidentiality order, with formal orders due on June 4 if the two companies strike an “agreed position”. If not, directions will be issued governing how any remaining disputes may be resolved.
Wagners took a financial hit last year after suspending supplies and launching legal action against its biggest cement customer over a pricing dispute.
It accused Boral of trying to force down contract prices after saying it was offered cheaper supplies by an unnamed rival — believed to be Cement Australia, a 50/50 joint-venture between Swiss giant Holcim and HeidelbergCement’s Hanson.
Wagners resumed deliveries to Boral on October 22, which takes about 40 per cent of its cement, while it disputed the bona fides of the rival offer via dispute resolution procedures in its contract. Both firms would not comment on Tuesday, with Wagners’ trading halt expected to be lifted on Wednesday.
