Emma Walters fights murder plot charges relating to CFMEU boss John Setka

The estranged wife of union heavyweight John Setka has appeared in a Melbourne courtroom on charges she was plotting his death.

The estranged wife of Victorian union boss John Setka has made another appearance in court, as she fights charges alleging she plotted to kill her husband.

Emma Walters was first arrested by Victoria Police in March, when she was alleged to have told private investigator Adrian Peeters she wanted to kill her husband.

She was charged with incitement to commit conspiracy to murder, incitement to acquire a firearm and making threats to kill Mr Setka.

Documents released by the Melbourne Magistrate’s Court on Monday reveal Ms Walters, 46, has since been charged with trying to incite a person to traffick a drug of dependence, and trying to incite a person to possess a drug of dependence.

She was also charged with committing an indictable offence, namely incitement to commit conspiracy to murder, while on bail.

Th ex-lawyer, who has previously denied the allegation she was plotting to kill Mr Setka in a statement to The Herald Sun, beamed into her most recent hearing via a videolink.

Ms Walters, whose address is listed as West Footscray, is alleged to have committed the newer offences while heavily intoxicated in the back of an ambulance, according to The Age newspaper.

It said Ms Walters was lapsing in and out of consciousness when she asked an ambulance attendant if there were any sedatives she could use “for him.”

Police unsuccessfully sought to revoke her bail in May, arguing that she was still trying to kill Mr Setka and could succeed.

Setka, 59, is the Victorian Secretary of the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU).

In a brief hearing in the Melbourne Magistrates’ Court on Monday, Magistrate Guillaume Bailin said he had reviewed a preliminary brief of evidence against Ms Walters contained in what is known as a hand-up brief, and listed the matter for a committal hearing in November.
