Corey Comport on drugs and unlicensed when he caused fatal collision, court told

Startling claims have been aired in court about a man police allege caused a deadly three-car crash in Melbourne last year.

The family of a man who died in a horror car accident allegedly caused by an unlicensed driver who was evading police are “horrified” the accused person can apply for bail, a court has been told.

The Melbourne Magistrates’ Court was told on Monday that father of two and talented singer Nirvair Singh, 44, died as a result of the injuries he sustained in the crash, which prosecutors said was a three-car pileup that occurred in Melbourne’s north on August 30 last year.

Prosecutors allege Corey Comport, 23, at the time, had never held a driver’s licence and had been using GHB, meth, ketamine and other substances when he crashed a rented Kia Cerato into the back of a Jeep Wrangler at more than double the 80km/h speed limit on Bulla-Diggers Rest Rd about 3.25pm.

Detective Acting Sergeant Jeremy Nelson told the court the Jeep Wrangler was pushed into the direction of a Toyota Kluger driven by Mr Singh.

Sergeant Nelson told the court that police had been pursuing the accused, who he said was driving at 168km/ h at the time of the collision.

He said police would allege there were multiple witnesses who had observed Mr Comport driving erratically with his partner, Rebecca Portelli, in the passenger seat in the lead-up to the collision.

Sergeant Nelson told the court the Kia Cerato, which he said had been hired from GoGet by the accused’s mother, rolled and came to rest on its roof following the crash.

He also told the court the family of Mr Singh, who attended Monday’s hearing, were “horrified” and “just shocked” that Mr Comport was able to apply for bail.

Tim Smurthwaite, acting for Mr Comport, said his client had an intellectual disability and schizophrenia, the latter leading to two episodes of involuntary treatment.

Mr Smurthwaite said there were no direct eyewitnesses of the collision and there were “some gaps” in the prosecution case.

Magistrate Daniel Muling adjourned the remainder of the bail application to January 24.
