Cole Miller: Prosecutors wait for medical reports into alleged one-punch death

Crown prosecutors are awaiting expert medical reports into the alleged one-punch death of Brisbane athlete Cole Miller before the case can proceed in court.

Daniel Maxwell and Armstrong Renata, both 21, remain in custody, charged over the alleged coward punch death of the young water polo player in early January.

Mr Miller died of massive head injuries in hospital the day after he was allegedly felled by a single blow inflicted by Mr Renata, in an alleged unprovoked attack started by Mr Maxwell.

Both men have been charged with unlawful striking causing death.

The case was listed for mention in Brisbane Magistrates Court on Monday, however, lawyers for the Director of Public Prosecutions said they were awaiting both neurological and pathology reports and requested a six-week adjournment.

A committal hearing date to determine if there is sufficient evidence to send the pair to trial in the Supreme Court has not yet been set.

Both Mr Renata and Mr Maxwell have been in custody since their arrests on the night of the alleged attack on Mr Miller.

Mr Maxwell has unsuccessfully applied for bail twice.

His first application was denied at the magistrates court level, while his second in the Supreme Court was abandoned when his lawyers received notification from Australian Border Force that, if released on bail, the New Zealand citizen would be taken into immigration detention.

The case is due to return to court on July 4.
