A COMPANY charged over the death of Inpex worker Carl Delaney in 2017 is planning to dispute a judge’s decision not to quash the charges against them.
Australian company Whittens Group and Japanese company Kawasaki Heavy Industries were both charged by NT WorkSafe after Mr Delaney died when he fell from scaffolding and was engulfed by perlite insulation dust in November 2017, causing him to suffocate.
Darwin Local Court Judge Tanya Fong Lim ruled last month that charges against Kawasaki would be quashed, but that the charges against Whittens would remain despite lawyers for the company arguing the charges were “defective.”
However, barrister for Whittens Erica Thuijs told the Darwin Local Court on Monday that her client intends to seek judicial review of the decision.
“We have a motion ready to be filed,” she said.

The matter will return to court in December.
