WorkSafe charge Mpriza Group, Nicolas Zikos for allegedly failing in their duty of care

A Top End company and its manager are facing more than $7m in fines after WorkSafe allege their workers were not properly protected.

NT WorkSafe has charged a Top End company and its manager for allegedly failing to ensure their workers had fall protection while working on the roof of a commercial building.

NT WorkSafe allege Mpriza Group Pty Ltd workers failed to use fall protection while installing solar panels on the roof of a commercial building.

Members of the public alerted WorkSafe to the issues, alleging not all workers had tethered the harness they wore to manage the risks of a fall.

The alleged incidents haven’t over a four day period in August 2023, which included two visits from WorkSafe inspectors.

The supervising manager and a first year apprentice were among the workers alleged to not be using fall protection.

Mpriza Group provides solar, electrical and air-conditioning services.

Worksafe has charged them with two counts of reckless conduct for failing in their primary duty of care, and one count of failing to comply with their health and safety duty.

Manager Nicholas Zikos has been charged as an officer under the act with two counts of reckless conduct charges for failing in his duty of care, and failing to comply with his health and safety duty.

If found guilty of all charges Mpriza Group Pty Ltd faces a combined maximum penalty of $6.05m, while Mr Zikos could be fined a maximum $1.25m, spend five years in prison or both, if found guilty.

The matter is listed for a mention in the Darwin Local Court on January 29.
