A warrant for the arrest of a former Darwin realtor has been vacated after she strolled into the courtroom just hours after authorities were directed to find her.

Wearing sunglasses and heels, Suzi Milgate was talking on the phone when she walked into the courtroom, hours after a warrant had been issued by Judge Therese Austin on Friday morning.

“Ms Milgate, I will not have phones in my courtroom,” Judge Austin quipped.

Ms Milgate hung up and apologised before telling the court she “had a migraine”.

Judge Austin asked if Ms Milgate wanted to have her warrant vacated, to which she agreed.

Ms Milgate indicated she would self-represent, however requested the hearing on October 16 be adjourned for an appointment with a psychiatrist.

Though Judge Austin said she would not vacate the hearing and suggested Ms Milgate “agitate the adjournment application on the Wednesday”.

The court heard Ms Milgate’s bail requirements remained the same until the hearing.

Judge Austin said Ms Milgate would be “required to attend” the hearing whether she self-represents or not.

The former realtor is accused of assaulting former Chief Minister Natasha Fyles with a crepe at the Nightcliff Markets in 2023.

Ms Milgate had earlier on Friday been expected to appear for a case management inquiry, ahead of a hearing next week.

However, she had instead sent a medical certificate stating she was unfit for work between October 10 and October 18 – dates that encompassed both court appearances.

When initially issuing the warrant, Judge Austin deemed the medical certificate as insufficient and noted Ms Milgate’s previous evasiveness to appear in court.

“She could have made other arrangements, including seeking to appear on the phone, Ms Austin said.

“The court is not satisfied the medical certificate is sufficient to cover a non-attendance without further medical or expert evidence supporting her assertions.

“I’m not suggesting that she may not have an issue, but the evidence is insufficient to satisfy this court that she was unable to appear.”
