Department of Education loses court case to force Adelaide River parents Kirsty and Michael Higgins to send three children to school

AN Adelaide River mum and dad have been found not guilty over their refusal to send their three children to school.

Chief magistrate John Lowndes told the Darwin Magistrates Court he “couldn’t be satisfied beyond reasonable doubt” Kirsty and Michael Higgins had failed to ensure the attendance of their school-aged children.

Mr Higgins said the family would not lodge an application to have the NT Department of Education pay costs associated with the legal proceedings, but noted “it has cost us in more ways than one”.

The Department took the Higgins family to court after it discovered the children had not attended Adelaide River School between March and August last year.

The children have not returned to school this year.
