A jury has decided the son of a well known Mount Isa family did rape a woman in his home three years ago.

The jury finalised their deliberation on Friday afternoon taking over six hours to make their decision and stated they found Daniel Giuseppe Grimaldi guilty on three counts of rape.

One charge of rape and one charge of sexual assault were discharged.

Grimaldi sat silent in the dock as he heard the jury read the verdict.

Earlier in the trial crown prosecutor Andrew Walklate told that the 36-year-old had ignored the victims wishes after they went home together to have consensual sex and instead sought out his own sexual gratification.

“A young woman made a choice to go home with a man who was significantly older than her, bigger than her, in his town and she had consensual sex with him … but there was no discussion about anal sex,” Mr Walklate said.

“He in no way considered her view at all when he put his penis into her bottom on any of those occasions.”

Mr Walklate said Grimaldi had ignored the victims pleas to stop and told her to “relax”.

“He had not discussed it with her, she had not said or done anything which gave him permission to do that, it hurt her because she was not prepared for it or expecting it,” he said.

“She pushed him away and she told him she did not want to do that.”

The crown said the woman’s account of the alleged offence was credible because of the level of detail in the evidence she gave, despite the topics being uncomfortable and embarrassing for the complainant to tell to the court.

Grimaldi is set to be sentenced on Tuesday and will remain in custody.
